Thrive Virtual Assistance LLC DBA Klever "Klever"  Terms of Service

Klever is a website platform that connects companies with workers for job and project opportunities. By using Klever, you agree to be bound by these Terms of Service (the "Terms"). Please read them carefully.

‍1. About Klever Klever is a platform, not an employment agency. We do not directly employ the workers on our platform, and we do not guarantee their performance or quality of work. Companies are responsible for conducting their own due diligence before working with workers, and for complying with all applicable employment laws and regulations.

‍2. Eligibility To use Klever, you must be at least 18 years old and have the legal capacity to enter into contracts.

‍3. Worker Vetting Klever vets workers for basic working traits such as communication, attitude, and experience. However, we do not conduct background checks. Companies are encouraged to conduct their own due diligence before working with workers.

‍4. No Guarantees Klever does not guarantee the performance or quality of work of any individual worker. We also do not guarantee that you will find workers who meet your specific needs.

‍5. Direct Working Relationships Companies work directly with workers through Klever, and are responsible for their working arrangements, including payment, benefits, and (if applicable) taxes.

‍6. Respectful Conduct Companies and workers agree to treat each other with respect and abide by all applicable laws. This includes, but is not limited to, avoiding discrimination, harassment, and illegal activity.

‍7. Worker Availability Workers agree to respond to companies within 72 hours if they have open availability set in their settings. If they do not respond within 72 hours, they may be removed from the platform. Workers can set their availability to "none" if they do not want to be contacted.

‍8. Removal and Banning Klever reserves the right to remove and ban companies and workers from the platform at any time, for any reason, including but not limited to:Rude conductViolation of lawsMistreatment of Companies or workersNot following platform rules

‍9. Payment There are no refunds for any fees paid to Klever.

‍10. Disclaimer Klever disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Klever is not liable for any damages arising out of your use of the platform, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

‍11. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions.

‍12. Entire Agreement These Terms constitute the entire agreement between you and Klever with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

‍13. Amendment Klever may amend these Terms at any time by posting the amended Terms on the Klever website. The amended Terms will be effective immediately upon posting.

‍14. Severability If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

‍15. Waiver No waiver of any provision of these Terms shall be effective unless in writing and signed by Klever.
